Abstract
Background. The relevance of examining the legal relations of legal liability is predetermined by both theoretical and legal factors. Firstly, the analysis shows that scientific papers mainly focus on protective legal relations and such a variety as legal relations of legal liability. As a result, there is an imbalance in the phenomena studied in science, which cannot have a positive effect on le-gal practice, the effectiveness of which largely depends on the results of legal science. Secondly, legal practice, including legislative activity, does not often distinguish such phenomena as release from liability and exemption of legal liability, which cannot positively affect the state of law and order. The aim of this study is to identify specific features of legal relations that release from legal liability. Materials and methods. In the study, such methods as dialectical and formal legal methods, methods of analysis and synthesis, deduction and induction, as well as algorithms peculiar to research of paired legal categories are used. Results. The definitions of the concepts of “legal relations”, “legal relations of legal liability” and “legal relations releasing from legal liability” are compared, the essential features of legal relations releasing from legal liability necessary to formulate the definition of this concept are revealed. The study suggests that legal relations of legal liability can be implemented without the participation of the state on a voluntary basis and that the concepts of “release from legal liability” and “release from punishment” should be differentiated. Conclusions. The dualistic nature of several legal relations that release from legal liability is determined. The author formulates the definition of the concept under study.
